GENERAL TICKET PURCHASE TERMS AND CONDITIONS 

Tickets will be issued at the discretion of Sussex Cricket Limited (SCL) on the following terms and conditions (the “Terms and Conditions”).  Any person who purchases, possesses or attempts to use a ticket issued under these Terms and Conditions (“Ticket(s)”) shall be deemed to have accepted and agreed to comply with  these Terms and Conditions:- 

  

  1. SCL reserves the right to refuse the sale of Tickets to individuals or agencies if it reasonably believes such person or persons are intending to re-sell such Tickets. SCL also reserves the right to refuse the sale of Tickets to anyone who is subject to a current prohibition preventing them from purchasing Tickets due to a prior contravention of SCL’s ticket Terms and Conditions. 

  1. SCL reserve the right to cancel any orders exceeding the stated Ticket limit including any orders made by customers having the same name, billing address or credit card details. 

  1. Unless via our own official ticket exchange, tickets may not be auctioned, offered for sale or re-sold above face value (whether by an applicant or any third party) under any circumstances. Any Tickets auctioned, offered for sale or re-sold above face value (whether on the internet or elsewhere and whether by an applicant or any third party), shall be void and all rights conferred or evidenced by such Ticket shall be nullified. 

  1. Ticket(s) shall not, without the prior written permission of SCL be: 

  • used for any promotion, advertising, fundraising, auction, raffle or any other similar commercial or non-commercial purpose; 
  • used as a prize (or part of a prize) in any contest, competition, (promotional) game of chance, lottery or sweepstake; 
  • combined with and sold or transferred as part of any package of goods or services; or 
  • combined with and sold or transferred as part of any travel, accommodation or hospitality package. 
  1. All Tickets remain the property of SCL at all times and we reserve the right to move the location of bookings. 

  1. Anyone who sells or transfers Tickets not in accordance with these Terms and Conditions or otherwise breaches these Terms and Conditions will risk losing the right to purchase Tickets for a period of 4 years from the date of such breach. Any decision as to the loss of such rights shall be taken by SCL or its nominated representatives and any person(s) affected by such loss of rights shall have the right to appeal 

  1. The applicant assumes absolute responsibility for all Tickets purchased in his/her name and will be penalised in accordance with these Terms and Conditions if any Tickets allocated to him/her are used or offered for sale in contravention of these Terms and Conditions, whether or not such contravention took place with the knowledge of the applicant. 

  1. Tickets are issued subject to the Ground Regulations and Code of Conduct established by SCL. A copy of the full Ground Regulations and Code of Conduct currently in force is available on the Sussex Cricket website at www.sussexcricket.co.uk and is also available on application from the ticket office at Sussex Cricket. 

  1. SCL reserves the right to refuse admission or cancel the booking without notification (and without refund or compensation) to anyone who has acquired a Ticket in breach of these Terms and Conditions (an ‘Unlawful Ticket’). Unlawful Ticket holders will, if necessary, be ejected from the stadium, without refund or compensation, after they have entered the ground and may be liable to legal action. 

  1. SCL reserves the right to refuse admission or cancel the booking without notification (and without refund or compensation) to anyone who has purchased more than one ticket and not provided the full details of each attendee. 

  1. In the event SCL provide the opportunity to access a priority window, acquire a zero-value ticket(s) or pay a deposit to obtain the opportunity to purchase a ticket(s) in the future, the applicant acknowledges they do not possess the right to attend the match unless they complete the whole purchase process and therefore hold a valid, fully paid for, match day ticket 

  1. No exchanges are made, or refunds/credits given, other than those covered under the SCL refund policy (see 13.). Once a booking has been made it cannot be altered. 

  1. In the event of curtailment or cancellation of play due to rain or COVID-19 SCL shall operate any refund, credit or reimbursement which may be due to the applicant in accordance with its refund policy, the full details of which are available at www.sussexcricket.co.uk 

  1. SCL reserve the right to cancel, curtail, postpone or make alterations to the time, date, duration and location of any match in the event of unforeseen circumstances, including (without limitation), force majeure, safety and security concerns or other cause beyond the reasonable control of SCL. In the event of such action being taken, SCL shall not be liable for any refund, loss (including indirect or consequential loss), damage or expense caused. 

  1. Duplicate Tickets will only be issued as a replacement for a Ticket that has been lost, stolen or mislaid at the discretion of SCL. Requests made for a duplicate Ticket must be made by the original purchaser. 

  1. Any youth or junior tickets that have been purchased in advance can be transferred to an adult ticket upon payment of the relevant seat price. In addition, any junior tickets that have been purchased in advance can be transferred to a youth ticket upon payment of the relevant seat price. There are no downgrades on Tickets. Requests to transfer a ticket must be made by the original purchaser. 

  1. Tickets will be distributed in accordance with SCL’s distribution procedures, details of which are available from the Sussex Cricket ticket office upon request. 

  1. If SCL reasonably suspect an applicant has committed a ticket touting offence, it will notify the ECB who may in turn notify other First-Class Counties and the Marylebone Cricket Club and/or the relevant law enforcement authorities. By making an application for Tickets, the applicant agrees that SCL may disclose the applicant’s details for these purposes. 

  1. SCL reserves the right to change these Terms and Conditions from time to time. Where such change materially affects the rights of the applicant (and when the application has resulted in a purchase), the applicant will have the right to a full refund. 

  1. Applicants agree to these Terms and Conditions for themselves and, where more than one Ticket is issued to the applicant, on behalf of the person accompanying them. Applicants must inform the person accompanying them of these Terms and Conditions and obtain their agreement to abide by them. 

  1. Applicants’ acknowledge (regardless of whether they are allocated any Tickets) that SCL may use any information provided during their application for the purpose of processing applications and for SCL enforcement of its legal rights. 

  1. By attending The 1st Central County Ground, and subsequent other venues used by SCL, Ticket holders consent to photography, filming and sound recording of themselves as spectators and members of the crowd. SCL its licensees and those authorised by it may use such photographs, films and recordings (including any copies) without compensation or credit. 

  1. Any Ticket holder attending The 1st Central County Ground, and subsequent other venues used by SCL, shall not (other than for their own private and domestic use) record, use or transmit over the internet, radio, television or any other current or future media, any sound, image, recording or description of the match taking place (including any results, statistics, information or other data in respect of the match, whether in whole or in part) or the grounds of The 1st Central County Ground, and subsequent other venues used by SCL, or to assist any other person(s) conducting such activities. 

  1. Restricted view definition. You will be able to see the majority of the wicket. However, depending on your location in the ground, a large portion of the boundary rope and outfield will be blocked from view. 

  1. If any provision of these Terms and Conditions is declared by any judicial or other competent authority to be void, voidable, illegal or otherwise unenforceable the provision shall be amended in a reasonable manner or it may be severed from the terms. In either event the remaining provisions shall remain in full force and effect. 

  1. These Terms and Conditions (and the Ground Regulations, Code of Conduct and Refund Policy) constitute the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to these Terms and Conditions which is not already set out in these Terms and Conditions. 

  1. These Terms and Conditions shall be governed by the laws of England and Wales. Any dispute arising from or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.  Notwithstanding the foregoing, SCL reserve the right to pursue legal proceedings in a competent court of the applicant/Ticket holders’ domicile, where such proceedings shall be governed and interpreted in accordance with English law. 

  1. Nothing in these Terms and Conditions seeks to exclude or limit SCL liability for death or personal injury caused by its negligence, fraud or any other type of liability which cannot be excluded or limited by law. SCL aggregate liability in all other circumstances shall otherwise be limited to the face value of the applicant’s Ticket(s). 

  1. These Terms and Conditions shall not affect a person’s statutory rights as a consumer. 

  1. Any person not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999. 

  1. SCL will charge £5.00 per transaction for 2nd class Royal Mail delivery – there will be no charge when an e-ticket is selected. 

HOSPITALITY TERMS AND CONDITIONS 

Any person who purchases, possesses or attempts to use a hospitality package issued under the following Terms and Conditions (“Hospitality package(s)”) shall be deemed to have accepted and agreed to comply with these Terms and Conditions:- 

  1. In the event of the match being cancelled less than 24 hours prior to the scheduled start of play, no refunds will be made and patrons are still welcome to use the facilities. 

  1. Some of our menu items contain nuts, seeds and other allergens. Therefore, there may be some risk that traces of these could be in any dish served. Please notify us no later than 7 working days prior to your visit of any special dietary requirements. 

  1. The Client may only terminate an order by notice in writing to SCL. SCL shall be entitled to charge: 

  • The total value of the package ordered, verbally or in writing, if the cancellation is received less than 8 working weeks prior to the commencement of the event. 

  • 50% of the total value of the package ordered if the cancellation is received more than 8 but less than 12 weeks before. 

  • A 25% cancellation fee for any cancellation to a confirmed booking received greater than 12 weeks from an event. 

  1. SCL do not accept responsibility for loss or damage to any coats or other personal property of the Clients, its guests or representatives unless such loss or damage has been caused due to the negligence of the Club or its employees. 

  1. No beverages or food, without limitation, may be brought into the hospitality and corporate areas by the guests or representatives for consumption or sale on the premises, without the express prior written consent of SCL. 

  1. SCL reserves the right to judge acceptable levels of noise or behaviour of the Client, guests or representatives and the Client must take all steps necessary for corrective action. In the event of failure to comply with SCL’s requests, SCL reserves the right to stop any event without being liable for any refund or compensation.  

  1. It is not permissible to invite extra guests, as any unauthorised person seeking access will be politely refused. 

  1. Smoking is only permitted in designated areas of the ground, any Client or their guests failing to comply will be required to leave the premises without SCL being liable for any refund or compensation.  

  1. Any function or hospitality must finish at the time agreed when the booking is made. All corporate hospitality facilities will be open from gate opening times and for 30 minutes after play or from the time a match is officially abandoned.  

  1. SCL will not accept responsibility for the loss of any tickets or car parking passes once they have been collected or distributed to the Client 

  1. In the event SCL replace any lost tickets or car parking passes, the Client may be responsible for the payment of an administration fee. 

  1. Payment is due strictly 30 days from date of invoice. If payment is not received within this time the reservation will be resold. 

  1. Payment for a booking made within 8 weeks of an event is due in full at the time the booking is made. SCL reserves the right to cancel bookings where the payment terms are not met. 

  1. SCL will send the Clients match tickets and hospitality information following payment to the address provided at the time of booking. 

  1. Payment of invoices can be made by Cheque, BACS and Credit Card. For further information contact SCL’s Finance Department on 01273 827100. 

  1. Confirmation of final numbers must be received 7 working days before the event. 

  1. In the event of a reduction in guest numbers, cancellations, reduction or abandonment of play due poor weather, no refunds can be made. Your hospitality package will be available regardless. 

  1. In the event of a match being played behind closed doors, cancelled or rescheduled due to COVID-19 SCL will provide Clients with the option to defer their booking to a future match or receive a full refund of their booking. All refund requests will be required in writing and relevant details provided. 

  1. SCL reserve the right to cancel hospitality place(s) due to events beyond our reasonable control and/or should we believe it is reasonable to do so on health and safety grounds. If we cancel your place(s) in such circumstances, you will be eligible for a refund of the cancelled package. We have absolute discretion as to which hospitality places to cancel in a situation where reduced capacity at the venue result in a requirement to cancel a proportion of hospitality places.

  2. Whilst every effort will be made to present the packages exactly as described, SCL reserves the right to alter any package, where necessary, whilst maintaining the value of any package offered.
